FOSTERS GROUP – LINDEMANS EARLY HARVEST
HARVEST CLUB TERMS AND CONDITIONS

1. Membership of Lindemans Harvest Club (the Club) is governed by these Terms and Conditions. By becoming a member of the Club you have agreed to these Terms and Conditions.

2. Foster's reserves the right to amend these Terms and Conditions at any time. Club members' continued membership of the Club will constitute acceptance of any changes or revisions to the Terms and Conditions. Club members' failure to follow these Terms and Conditions may result in suspension or termination of their access to the Club website and the Club, without notice.

3. Club membership is open only to Australian residents aged 18 years or over.

4. To become a Club member, potential members must visit www.harvestclub.com.au (Website) and fully complete and submit the Club registration form by providing their name, email address, gender, age group, post code and any other information as required by Foster's.

5. Members can de-activate their Club registration by sending an email to remove@harvestclub.com.au. Upon receiving this email Foster's will remove the member's profile and registration details from its database and the member will no longer have access to the Club.

6. Successfully registered Club members will receive confirmation of their membership details by email.

7. Foster's accepts no responsibility for late, lost, incomplete, incorrectly submitted, indecipherable, delayed, illegible, corrupted or misdirected registration forms, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. Foster's has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. Foster's is not liable for any consequences of user error including (without limitation) costs incurred.

8. Membership of the Club is personal to each member and members must not authorise others to use their membership. Members must keep their log-in details, including user name and password, confidential. Members are responsible for all use of the Club under their membership.

9. It is a condition of membership of the Club that members keep their membership details up-to-date and accurate.  These can be updated on the Website.

10. Only one Club registration is permitted per person. Persons who are found to have more than one Club membership (whether due to multiple email addresses, aliases or otherwise) may be disqualified.  If there is a dispute as to the identity of a Club member, Foster's reserves the right, in its sole discretion, to decide the identity of the Club member.

11. Members of the Club will have the opportunity to participate in a points system by collecting points in accordance with the details and additional instructions provided on the Website.  Members' points will accumulate for the duration of their Club membership (subject to their redemption of the points for Points Offers – see paragraph ), or as otherwise determined by Foster's.  Foster's reserves the right in its absolute discretion to vary how members can accumulate points at any time and to change the structure of the points system at any time.

12. Upon the accumulation of certain points totals (as specified on the Website), Club members will be eligible to redeem their points for various offers and products (Points Offers).  Members will receive notification on their profile with details of the Points Offer they are eligible for.

13. Each Points Offer will only be valid for a limited period of time as detailed on the Website.  Foster's reserves the right to update or change the availability of the Points Offers.  Full details of each Points Offer will be outlined on the Website.

14. Points Offers will be reviewed and updated at Foster's discretion.  Points provide access to offers as outlined on the Website.  These points do not zero out, rather they continue to accumulate.  Points are not transferable, exchangeable or redeemable for cash.  If a member does not redeem their points during their Club membership, or within any other time period specified by Foster's, the points will be forfeited and cash or substitute items will not be provided in lieu of the forfeited points.

15. Club members will be given the opportunity to enter competitions from time to time via the Website, as well as the opportunity to take advantage of special offers.  Each competition and special offer is subject to terms and conditions which will be available to members via the Website.

16. Member offers are not transferable, exchangeable or redeemable for cash, unless otherwise specified.

17. As part of their Club membership members will be invited and encouraged to initiate and participate in Club discussions on the Website and submit and vote for photos on the Website.

18. All content provided to the Club by members becomes the property of Foster's and will not be returned to the entrant.  By participating in the Club, members:
	- consent to Foster's making copies of or publishing the whole or any part of the content provided by the member and otherwise exploiting the content and any rights in relation to the content, to publicise the Club or for any other purpose; and
    - undertake to Foster's that the content is not, and its use by Foster's will not be, in breach of any third party intellectual property rights.

19. Once submitted, entrants cannot alter or delete content provided to the Club.

20. Foster's, in its absolute discretion, may edit any part of a member's content submission.  By participating in the Club, members agree to Foster's editing, amending or otherwise varying the whole or any part of their content submission.

21. Members must not submit content which includes:
	- any image of any other person without that person's express consent.  Members warrant that if this content is included, they have obtained the express consent of the relevant person to their inclusion in the content submitted to the Club;
    - any content that contravenes any law, infringes the rights of any person or is obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate.  Without limitation, members must not include any content that involves nudity, malice, swearing or potentially defamatory material; and
    - any literary, dramatic, musical or artistic work or any other item in which copyright subsists, unless the member is entitled to do so.  If a member has any doubts about whether they have the right to include content they must not include it.  By including any item in their content submitted to the Club, the member warrants that they are entitled to do so.
    
22. Foster's reserves the right not to upload any content onto the Website and Foster's will have no liability to members in taking any such measure. By participating in the Club, members acknowledge that their content they submit may be made available online and may be accessible to the general public.

23. Foster's may, in its sole discretion, refuse to grant a membership, terminate a membership, suspend a membership, or terminate, suspend, cancel or otherwise modify the operation of the Club for any or no reason, without notice and without liability.  Foster's decisions are final and no correspondence will be entered into.

24. Any person who tampers with or benefits from any tampering with the operation of the Club or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person may have their Club membership terminated in Foster's discretion.

25. If for any reason any aspect of the Club is not capable of, or is not, running as planned including by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of Foster's which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Club, Foster's may in its sole discretion cancel, terminate, modify or suspend the Club, or invalidate any affected memberships.

26. Foster's and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Club (including the cancellation or modification of a membership or the Club itself) or accepting or using any offer, gift or prize provided in connection with a Club membership, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

27. The information members and potential members provide will be used by Foster's for the purpose of conducting the Club.  Foster's may disclose members' personal information to its contractors and agents to assist in conducting the Club or communicating with members.

28. By joining the Club, members have granted consent to the storage of their personal information on Foster's database and Foster's may use this information for future promotional and marketing purposes regarding Foster's products including contacting the entrant via electronic messaging.  Club Members can unsubscribe to the Club monthly updates by following the link contained in each monthly update. Foster's is bound by the National Privacy Principles in the Privacy Act 1988.  Entrants can request access to the personal information Foster's holds about them by contacting Foster's at the address below. Foster's privacy policy can be viewed at http://www.fosters.com.au/privacy.

29. The Harvest Club is conducted for Foster's Australia Limited by Foster's Wine Estates Limited ABN 55 004 094 599 trading as ‘Lindemans Hunter Valley' (Foster's). Offers are made and liquor supplied under its NSW Packaged Liquor Licence No. LIQP700356448.
