WIN 1 of 25 magazine subscriptions – Terms and Conditions

1 Information regarding the prize and how to enter forms part of these conditions. By entering, entrants accept these conditions.
2 Entry is open only to Australian residents aged 18 years or over. Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or of the agencies or companies associated with this competition are ineligible to enter.
3. The competition begins at 12.01am (local time) on 11/12/11 and ends at 11.59pm (local time) on 15/01/12 (Competition Period).
4. To enter, entrants must, during the Competition Period:
(a) the Promoter will send a promotional email to all Harvest Club members. The email will contain a unique code for use in entering this competition (Unique Code);
(b) after receiving the email participants must visit http://shop.lindemans.com.au and purchase a case of any Lindeman’s wine through the website (Eligible Purchase);
(c) during the check out process participants will be prompted to enter their Unique Code. Participants must also complete any other details required to make the Eligible Purchase; and
(d) once the Eligible Purchase has been made the participant will be automatically entered into the Competition.
Consumers are responsible for their own costs associated with accessing the internet.
5. Each entrant will receive an email confirming their Eligible Purchase has been made (Confirmation Email). By entering this competition, entrants consent to receiving this electronic message.
6. Entries must be received during the Competition Period. Entrants may enter as many times as they wish, provided that each entry is based on a separate Eligible Purchase. Entrants must retain their proof of purchase for each Eligible Purchase. Failure to provide this/these (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid). The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses or aliases may be disqualified.
7. The draw will be conducted at 2pm (AEDT) on 17/01/12 at Immediate Pty Ltd, 1/21 Wellington Street, St Kilda, VIC 3182. The first 25 valid entries randomly drawn from all valid entries received will each win a prize.
8. Each prize is a 12 month ACP magazine subscription of the winner’s choice (from the selection specified by the Promoter) valued at up to $75 (inc GST), depending on the magazine subscription chosen. Magazine subscriptions are subject to any additional terms and conditions specified by the supplier/s. Prize winners should allow up to 6-8 weeks for the delivery of the first issue of their selected magazine. Free gifts and tip-ons that may be available with retail copies of magazines are not provided with subscriber copies. Magazine subscriptions awarded as a prize cannot be taken in conjunction with any other subscription offer/promotion for the selected title and can only be delivered within Australia.
9. The total prize pool is valued at up to $1,875 (inc GST).
10. The winners will be notified in writing within 2 days of the draw.
11. The prize winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
12. The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
13. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 7.
14. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.
15. The judge’s decision is final no correspondence will be entered into.
16. Prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory if required.
17. If a prize has not been accepted or claimed within 3 months of the draw, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws at 2pm on 18/04/12 at the same location as the original draw as are necessary to distribute the prize, subject to any requirements of any gaming authority. Any winners in this draw will be notified in writing within 2 days of the draw.
18. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
19. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to any prizes.
20. The Promoter may communicate or advertise this competition using Facebook. The competition however, is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.
21. If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required.

22. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
23. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. Entry and continued participation in this competition is subject to the Promoter’s liquor serving policy.
24. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
